Restraining order on President NAASU

Colombo District Judge Rohini Walgama on Monday issued an enjoining order restraining Wing Commander D.S.B. Senaratne from functioning as the President of the National Amateur Aquatic Sports Union of Sri Lanka (NAASU).

The order was a sequel to an application by C. Vijitha Fernando of Dhakshinarama Road, Mount Lavinia.

Wing Commander D.S.B. Senaratne, NAASU Vice President Kithsiri Dayananda SP, its Secretary Gavin Amerasinghe, NAASU and Director-General Department of Sports Development Milton Amerasinghe have been cited as the defendants.

The plaintiff claimed that he was a member of the executive committee of NAASU representing the Panadura Aquatic Club which was a member of NASSU. NAASU was the sole governing authority for amateur aquatic sports such as swimming, diving, water polo and synchronised swimming and affiliated to Federation Internationale de Natation Amateur.

Plaintiff alleged that the first defendant who purported to have been appointed as the President of the NAASU failed to produce the proof of his qualification and was not qualified to hold the post of president of NAASU.

He further alleged that first defendant was holding the said position unlawfully, in violation of the NAASU constitution as he did not possess the requisite qualifications.

Plaintiff states that if first defendant continues as the president of NAASU plaintiff as well as the members of the NAASU would suffer irreparable loss and damage.

Nihal Jayamanne PC with Ronald Perera and S.D Yogendra instructed by Mather and Ramanathan appeared for the plaintiff.

The case was put off for December 12.
