FR application by CPC casual employees by Wasantha Ramanayake A group of casual employees of the Ceylon Petroleum Corporation filed a Fundamental Rights application in the Supreme Court against the failure of the Corporation to make them permanent, in terms of a circular issued by the Government. Petitioners S. W. A. Trimious Silva and 104 other employees cited the Ceylon Petroleum Corporation (CPC), its Chairman Daham Vimalasena, Personnel Manager C.R. Wickremaratne and the Attorney General as respondents. Petitioners claimed that they had been with the Corporation for more than 180 days and employed on contract basis. In terms of a circular issued by the Ministry of Provincial Councils and Local Government, casual employees of the government departments and corporations who had necessary qualifications and service over 180 days would be made permanent with effect from October 9, 2001. However, they alleged that the first to third respondents, the CPC, its chairman and the personnel manager had failed to make them permanent in their respective posts in violation of their Fundamental Rights. They further alleged that the respondents were being deprived of the other benefits which they should have been entitled to, if they were absorbed into the permanent cadre. The petitioners sought a court order directing the respondents to pay their backwages and other entitlements due to the failure of the respondents to include them in the permanent cadre and a compensation of one million rupees. |
