by Sandasen Marasinghe Colombo High Court Judge Sarath Ambepitiya yesterday issued a warrant, for the arrest of the vessel M.V. State of Nagaland flying the Indian National Flag, which is currently anchored outside the Colombo Harbour.This was sequel to a petition filed by Sri Lanka Telecom alleging that the said ship had damaged their submarine cable. According to the petition the damage is estimated at five million US dollars. The particular cable services 70% of the overseas Telecommunication network. It would take five days to repair the damage. The Sri Lanka Telecom observed the Maritime transmission, International Voice, Internet and Data Services have been interrupted since August 22. This cable is linked with the Mount Lavinia Telecommunication Network. The Sri Lanka Telecom learnt that the said ship is anchored in that area from the Colombo Harbour. Further the petition stated that the Submarine cable which extends 50 kms into the sea had been damaged by a length of 9.27 kms from the Mount Lavinia beach. The M. V. State of Nagaland ship was the only ship anchored in that area. The damage could not have been caused under natural circumstances. It has caused by this ship due to negligence. The ship was due to leave Sri Lanka on August 23 and the Director of the Merchant Shipping had issued a detention order on the ship till 5 p.m. on August 23. The High Court issued warrant for the arrest of the ship and writ of summons in rem. The case will be taken for hearing on September 6. |
