by Sandasen Marasingheby Sandasen Marasinghe A businessman who claimed he lost the sight of his left eye after being struck on the forehead by a pellet fired from a tear gas canister has filed a case against the Borella Police claiming Rs. 6 million as compensation. The incident took place on July 19, 2001, at the Borella junction. Petitioner R.A.F. Alfred de Alwis cited Superintendent of Police of Colombo South, K. Udayapala, Officer-in-Charge of Borella Police CIP Jagath Palihakkara, IP Douglas Nimal, former IGP T.E. Anandarajah and the Attorney General as respondents. The petitioner stated that he was a businessman who ran his business on the first floor of the Borella Supermarket. He received a shot on his forehead from a pellet fired from a tear gas canister on the day in question when he attempted to look out of his office as he heard sounds of a protest march from the direction of the Borella junction. The Petitioner further stated that he was admitted to the Colombo National Hospital and underwent surgery. He had to stay at the hospital for more than three weeks. Consequent to the incident he lost the sight of his left eye and is suffering from irritating pains in his head. The petitioner also claims he suffered financial loss since he had not been able to attend to his business on a regular basis due to his disability. Petitioner further noted that he faced this situation due to the negligence of a Police Officer who acted on the instructions of the first four respondents and claimed compensation in a sum of Rs. 6 million. |
