Notice issued on AG in writ application filed by Kumar Rupasinghe

The Appeal Court issued notice on the Attorney General in the writ
application filed by Kumar Rupasinghe compelling the IGP to take action
against JVP Propaganda Secretary Wimal Weerawansa. The Court issued
notice on the Attorney General to appraise the court the steps that had
taken in connection with the complaint made to the Maharagama Police by
petitioner Kumar Rupasinghe.
The Bench comprised Justices K. Sripavan and Sisira de Abrew. Upul
Jayasuriya, the counsel for the petitioner submitted that his client was
the founding chairman of the Foundation for Co-Existence (FCE), a non
profit making non-governmental organisation-NGO and was a global peace
campaigner.
The counsel submitted that the petitioner made a complaint to the
Maharagama Police that a speech made by Wimal Weerawansa in Maharagama
on April 6, identify him as a conspirator against Sri Lanka, a traitor
and a person more dangerous than LTTE leader Prabhakaran and his NGO as
one of the main agents in the movement that dissolve and dismantles the
country would provoke public to cause him harm.
The counsel submitted that the petitioner had subsequently complained
it to the IGP without success.
The counsel submitted that the omission of the part of the first
respondent IGP not to prosecute Weerawansa was arbitrary and
unreasonable.
The petitioner sought a Writ of Mandamus directing the first
respondent IGP to take necessary steps under the Penal Law against the
second respondent Wimal Weerawansa to arrest and produce him before an
appropriate Court of Law.
The petitioner cited IGP Chandra Fernando, JVP Propaganda Secretary
Parliamentarian Wimal Weerawansa, the JVP, its General Secretary Tilvin
Silva and the Attorney General as respondents. The notice is returnable
on October 24. |
