Businesswoman claims Rs. 100 million as damages

COLOMBO: A leading businesswoman of Rambodda Estate, Nirmala Vellasamy of Sunrise Traders, in Colombo has filed an action against a firm claiming Rs. 100 million as damages caused to her by an action filed in the District Court of Colombo against her by the defendant firm.

Plaintiff Vellasamy through Gangatharan Associates stated the defendant company had instituted a civil case in the Colombo District Court against her claiming monies.

Vellasamy stated the defendant had acted maliciously in the said application to arrest her, wrongfully, unlawfully and without any right thereto abused the legal process.

The plaintiff also stated the defendant caused an application to be made for a warrant to be issued to arrest her. The warrant for the arrest has been re-called and set aside by the court.

There was absence of reasonable and probable cause on the part of the defendant.

The plaintiff was arrested and imprisoned. The defendant acted maliciously.

She pleads the defendant's actions have caused the plaintiff physical harassment, pain of mind and loss of business and reputation.

The plaintiff also stated that due to the actions and the plaintiff being unable to conduct her business activities whilst in custody and as a woman the plaintiff and her business activities have been caused severe loss and damage.

She pleads she never intended to leave or quit the country.
