CIMA granted leave to proceed

The Supreme Court granted leave to Proceed with the Fundamental
Rights Application filed by members of CIMA Sri Lanka Divisional Council
seeking to formulate necessary regulatory mechanisms to regulate the
foreign institutions providing education service in Sri Lanka.
Counsel Sanjeewa Jayawardane for the petitioner council submitted
that the 28 respondent, President of the Charted Institute of Management
of London suspended the Sri Lanka Divisional Council on December 28,
2008 arbitrarily without any legal basis since there is no regulatory
mechanisms set down by the Government to regulate Foreign Institutions
providing education services in Sri Lanka. The failure to set down such
regulations are in violation of the rights of the petitioners.
The petitioners also sought an interim order staying the purported
suspension of the CIMA Sri Lanka Divisional Council until the final
determination of the rights application.
The Bench comprised Chief Justice Sarath N. Silva PC and Justices
Jagath Balapatabendi and S.I. Imam. Sanjeewa Jayawradane with Rajeeva
Amarasuriya instructed by G.G. Arul Pragasam appeared for the
petitioners.
The application will be mentioned on March 16.
