CEB Engineers salary increase illegal, Appeal Court rules

The Court of Appeal yesterday ruled that salary increase for the Engineers and Engineering Assistants in the Ceylon Electricity Board (CEB) in 2014 was illegal.

Accordingly, the Court of Appeal issued a writ of certiorari quashing the Circular issued in November 27, 2014 known as “Unified Engineering Service” creating a special salary scale known as “E Salary Scale” for the Engineers and Engineering Assistants in the Ceylon Electricity Board (CEB).

Court of Appeal Justice Mahinda Samayawardhena observed that the decision taken by the CEB was ex-facie illegal and ordered to quash the circular dated 27.11.2014.

The Court of Appeal further ordered the CEB to pay a sum of Rs.200,000 as the legal cost of the application.

The Court of Appeal made this order persuent to a writ petition filed by Lanka Viduli Podu Sevaka Sangamaya naming CEB and several others as respondents.

The petitioner stated that Board Meeting of the Ceylon Electricity Board was held 26.11.2014 at 4.00pm and presented a minutes under the heading “Progress of the proposed collective agreement and the salary increase for the employees of the CEB.

The petitioner stated that this is unmistakably illegal and arbitrary, which created a great salary anomaly between the Engineering employees and the other employees of the CEB gravely endangering industrial peace.

The petitioner said after the said decisions by the CEB, 30% salary was increased effective from 01.01.2015 for the next three years.
