Former CB Deputy Governor, Geoffrey Aloysious, PTL Directors granted bail

Former Central Bank Deputy Governor P. Samarasiri and four Directors of Perpetual Treasuries Limited (PTL) including its Chairman Geoffrey Aloysious, who were held in remand custody in connection with the Central Bank Bond Scam, were yesterday granted bail by Colombo Chief Magistrate Lanka Jayarathne.

Chairman of the Perpetual Traesuries Private Limited Geoffrey Aloysious and former Deputy Governor of the Central Bank P. Samarasiri were released on a cash bail of Rs.100,000 and two sureties of Rs.2,000,000 each.

Three Directors of the Perpetual Treasuries Private Limited Pushpamitra Gunawardena, Chitta Ranjan Hulugalle and Muthuraja Surendran were released on two sureties of Rs.1,000,000 each.

The Chief Magistrate also imposed a travel ban on each suspect ordered them to handover their passports before the court.

The Magistrate observed that the suspects had been arrested for allegedly committing offenses under the Section (56) of the Registered Stocks and Securities Ordinance Act and thereby the Magistrate has jurisdiction to grant bail.

The Magistrate further observed that the suspects had extended their cooperation to the Criminal Investigations Department after visiting it on several occasions to provide their statements. The Chief Magistrate observed that there is no possibility of evading the court by the suspects. The Magistrate further observed that she was of the belief that there would not be any public disquiet if the suspects were released on bail. She further stated that there are no any previous offenses against the suspects.

On the previous occasion, the Magistrate ordered that the suspects be remanded by considering the heavy losses incurred by the government and the seriousness of the offences committed by the suspects. The Magistrate also observed that a public disturbance can happen by granting the suspects on bail.

Senior Deputy Solicitor General Haripriya Jayasundara appearing on behalf of the Criminal Investigations Department pleaded to issue an order directing the Director of the PTL Ajan Punchihewa to appear before the CID to provide a statement. SDSG Jayasundara further stated that suspect had already gone abroad.

SDSG Jayasundara told the court that the Director of the Criminal Investigations Department had sent an email to Ajan Punchihewa through his official email to appear before the CID and provide a statement regarding the incident.

After taking into consideration,the Magistrate issued notice on the Direcor of the PTL Ajan Punchihewa to appear before the CID on June 26. The Magistrate also ordered to send the notice through express registered post.

Counsels appearing on behalf of the suspects pleaded their clients be granted bail.

President’s Counsel Nalin Ladduwahetti and President’s Counsel Upul Jayasundara and Attorneys Jeewantha Jayathilake,Gunathilake and Sanjaya Gamage appeared on behalf of the suspects.
