Release of Riyad Bathuideen in the face of incomplete investigations unjustified - AG

Attorney General Dappula De Livera said that the release of former Minister Rishad Bathuideen’s brother, Riyad Bathuideen who was arrested by the CID on suspicion of aiding and abetting the terrorists who carried out the Easter Sunday attacks, in the face of incomplete investigations is unjustified.

Coordinating Officer to the Attorney General State Counsel Nishara Jayaratne told the news media that the Attorney General also given instructions in written to the DIG of CID on the need for further investigations into the incident and the action to be taken in this regard and had instructed him to submit the complete investigation files within a month.

"Attorney General Dappula de Livera has summoned Deputy Inspector General (DIG) of the Criminal Investigation Department (CID) and the Chief Investigating Officer to meet him yesterday along with the investigative materials over the release of Riyad Bathuideen by the CID.

"Following that, DIG of CID Prasad Ranasinghe, Senior Superintendent of Police and CID Director Prasanna de Alwis, Assistant Superintendent of Police Vijitha Perera and Chief Investigating Officer Sugath Kumara met the Attorney General at Attorney General’s Department yesterday.

"During the discussion held with them at the Department, the Attorney General observed that former DIG of the CID Nuwan Wedasinghe had failed to investigate money laundering offences against Riyad Bathuideen such as failure to properly investigate his assets, liabilities, vehicles, bank accounts, banking transactions and business affairs.

"Also, it has been revealed that no extensive investigation has been carried out into the use of funds for terrorist activities by Riyad Bathuideen.

"Furthermore, the CID had failed to find 12 out of the 16 mobile phones used by Riyad Bathuideen and investigations in to the missing phones had not been carried out properly.

"Accordingly, it was revealed that the CID had not carried out proper investigations into the above matters," she said.

She further said that it was revealed that the CID had appointed officers who have no knowledge about Money Laundering to investigate the matter.

"Considering the facts the Attorney General said that successful results of further investigations into the incident were hampered due to the suspension of the investigations by the DIG of CID Nuwan Wedasinghe and CID Director Prasanna de Alwis and that the release of the suspect could not be justified," she added.

Riyad Bathuideen was arrested on April 14 by the CID on suspicion of aiding and abetting the terrorists based on the 07 phone calls which received from Insaaf Ahamed who carried out the bomb blast at Cinnamon Grand Hotel in the series of Easter Sunday attacks which took place on April 21, 2019.

The CID had obtained two detention orders against Riyad Bathiudeen on April 17, 2020 and July 13, 2020.

Although the detention orders were due to expire on October 13, the former DIG of CID Nuwan Wedasinghe requested to suspend the investigations over the incident on September 6, 2020 and that the detention order be revoked on September 28, 2020 and release Riyad Bathuideen on September 30, 2020.

While there is strong evidence leading to proceed legal actions, the CID had decided to release Riyad Bathuideen without any legal permission and by not producing him before the Court.
