Prof. Saumya Liyanage files FR challenging termination of services

Award-winning actor and former Dean of the Faculty of Graduate Studies to the University of the Visual and Performing Arts, Prof. Saumya Liyanage has filed a Fundamental Rights petition in Supreme Court challenging the decision to terminate his service as a Professor of the Visual and Performing Arts University and demoting him to the Post of Temporary Lecturer. 

The University of the Visual and Performing Arts had taken a decision to terminate the Petitioner from functioning as a Professor on the basis that the rationale adopted by the then Governing Council to promote the Petitioner to the post of Senior Lecturer (Grade II) was erroneous and was in contrary to the provisions provided in the Establishment Code of the University Grants Commission and the other higher education institutions, as well as the Universities Act No. 16 of 1978 (amended). 

Through this petition, Prof. Liyanage is seeking an interim order staying the decision made by 27 respondents, including the members of the governing council of the university and University Grants Commission, from enforcing the letter issued to terminate him from functioning as a professor dated September 25. 

The petitioner is also seeking a declaration that actions and omissions by the respondents are in violation of the Fundamental Rights of the petitioner as guaranteed by Article 12 (1) and Article 14(1) (g) of the Constitution. 

Meanwhile, Peshala Manoj who had been served as an Assistant Accompanist (tabla) at the University of the Visual and Performing Arts also filed a writ petition in the Court of Appeal challenging his termination from the service.
