EC has no authority to summon Ministry Secretaries

Senior minister calls for govt to act on his action

A senior government Minister said that the Election Commission doesn’t have any authority to summon the Public Administration Ministry Secretary before the Commission unless he voluntarily presents himself.

He further said that if the Chairman and Director General of the Election Commission summon the Secretary of the Ministry of Public Administration before the Commission, it is a completely illegal act.

The senior government Minister mentioned the above fact while commenting on the statement made by the Election Commission Chairman that he would call the Public Administration Ministry Secretary to inquire about the letter issued to the District Secretaries not to accept election deposits for the Local Government elections and expected to take all possible steps regarding the issuance of that letter.

Besides, the Chairman and Director General of the Election Commission bypassing the Attorney General and taking the advice of another senior lawyer is a grave mistake in law, so the government will have to act in this regard, the Minister further stated. He further emphasized that neither the president nor the government had any influence on the Election Commission regarding the conduct of the Local Government elections.

According to the information received by the government, the senior Minister pointed out that the government has observed that the division of the Election Commission is still in that form and said that the decisions of the Chairman or the Director General of the Election Commission are not the decisions of the entire Commission.

He stated that it seems that the Commission did not take any preliminary measures related to the holding of the Local Government election and also mentioned that the nomination should be called after all the related preliminary measures have been taken.
