The case filed against former MP Johnston Fernando and two others over the bribery case filed against them for allegedly causing around 11 million unlawful loss to the government by excluding employees of the Co-operative Wholesale Establishment (CWE) from their duties and engaged them in political activities, was fixed for February 28 to file Preliminary objections over the case.
When the case was taken up before Colombo High Court Judge Navarathne Marasinghe, the Bribery Commission filed written objections before the court against the preliminary objection made by the President’s Counsel Kalinga Indatissa on behalf of the defence stating that there is no legal capacity to proceed with the case.
The defense sought from the court to give them another date as they intend to present a further preliminary objection against the complaint.Accordingly, the case was fixed for February 28.
The case was filed against former Minister Johnston Fernando when he was acting as the Trade Minister, former CWE (Lak Sathosa) Chairman Eraj Fernando and former minister’s private secretary Raj Mohideen Mohammad Zakeer for allegedly causing an Rs.11,093,615.73 (around 11 million) unlawful loss to the government by employing the employees of the Cooperative Wholesale Establishment (CWE) for election work during the period 2012.The Director General of the Commission to Investigate Allegations of Bribery or Corruption filed these corruption cases against three accused under Section 70 of the Bribery Act on four charges.
