Police officer ordered to pay Rs. 50,000 to doctor in FR case

The Supreme Court yesterday ruled that the fundamental rights of a doctor who went to the Police station to complain about a threat against him was beaten and kept in the Police cell has been violated. 

The Supreme Court ordered the Inspector General of Police (IGP) yesterday (25) to take disciplinary action against the former Officer-In-Charge of the Minor Complaints Division of the Thalangama Police Station who was involved in this incident which took place in 2018.

He was ordered to pay Rs.50,000 from his personal funds to the doctor concerned as compensation for the violation of the said fundamental rights and in addition the government was also ordered to pay Rs.50,000 to the doctor.

The Supreme Court made these orders after examining a petition filed by Dr.Harendra De Silva Jayasinghe requesting that his fundamental rights be declared violated as a result of the related incident.

When this petition was called before the Bench of Supreme Court Justices Priyantha Jayawardene, S.Thurairaja and Kumuduni Wickramasinghe, the decision was announced by Justice Wickramasinghe.

During the petition hearing, facts were presented that when the doctor went to the Thalangama

Police Station on November 16, 2018 to make a complaint regarding a threat made to him by a group of persons, they grabbed him by the shirt he was wearing and put him in the police cell without paying attention to his complaint. After considering the facts, the court announced its decision and stated that it accepts the facts presented in this petition.

Supreme Court Judge Kumuduni Wickramasinghe stated that the incident had violated 13(1)fundamental rights of the Constitution. Attorney Harsha Fernando appeared for the petitioner.
