Rajitha’s amended anticipatory bail application fixed for inquiry on Dec.30

An amended anticipatory bail application filed by former Minister Rajitha Senaratne seeking an order to release him on bail if he was arrested over the ‘white van’ incident was yesterday fixed for inquiry on December 30 by Colombo Additional Magistrate Priyantha Liyanage.

On December 20, former Minister Dr. Rajitha Senaratne had filed an amended anticipatory bail application with the Colombo Chief Magistrate’s Court seeking to prevent his arrest over a media briefing which took place white van abduction.

The respondents were represented by Deputy Solicitor General Dileepa Peiris. The petitioner had named Chief Inspector Ravindra Wimalasiri and CID Director Senior Superintendent of Police W.Thilakarathne as the respondents.

When the petition was taken up for hearing, President’s Counsel Wasantha Nawarathna Bandara appearing on behalf of the petitioner informed court that the amended anticipatory bail application has been filed pertaining to Section 21(3)of the Bail Act.

“The petitioner has not appeared before the court on charges of murder or robbery,” President’s Counsel Wasantha Nawarathne Bandara further stated.

President Counsel Wasantha Nawarathne Bandara pointed out that the Colombo Chief Magistrate had earlier dismissed an ancipatory bail application filed by the petitioner on December 19.The Colombo Chief Magistrate had earlier dismissed the petition because the petitioner had failed to clearly stipulate the offenses for which he is being arrested by the Criminal Investigations Department.

President’s Counsel Bandara further told court that the petitioner had undergone open heart surgery on February 26, 2016 at Mount Elizabeth hospital in Singapore. The petitioner is a doctor and also a sitting Parliamentrian.

“We have clearly mentioned under which sections of the Penal Code the petitioner would be arrested by the Criminal Investigation Department. The pettioner would be arrested under Section 485 and 192 of the Penal Code,”President’s Counsel Bandara stated.

“The Government is planning to arrest the petitioner in order to seek political revenge.On December 18,former MP Patali Champika Ranawaka was arrested and remanded. The next MP is former Minister Rajitha Senaratne. There is a fear that this petitioner would be arrested according to Section 192 and 485 of the Penal code and remanded without recourse for bail.

President Counsel Nawathna Bandara also pleaded to issue notices on the respondents.

In reply, Deputy Solicitor General Dileepa Peiris raised preliminary objections against the petition filed by the former Minister Rajitha Senaratne.

DSG Dileepa Piries also stated that petitioner had filed three anticipatory bail application before the Colombo Chief Magistrate’s court and respondents recieved notices. DSG Piries stated that pettioner filed another fresh bail appilication on yesterday evening.

“The petitioner has to show reasonable ground which that he would be arrested for non-bailable offences and there should be special circumstance to the court to grant anticipatory bail. According to the anticipatory bail application filed, petitioner had failed to specifically mentioned about the special circumstances that why he needs anticipatory bail”, DSG Dileepa Peiris further told the court.

 

Taking the submissions into consideration, the Magistrate issued notices on the two respondents to appear before the court on December 30.

‘White Van’ incident : Rajitha files third anticipatory bail application - UPDATE (12:10)

Former Minister Rajitha Senaratne filed his third anticipatory bail application in the Colombo Chief Magistrate’s Court to prevent his arrest over white van incident today.

Colombo Chief Magistrate Lanka Jayarathne today rejected his second anticipatory bail application filed by former Minister Rajitha Senaratne seeking an order to release him on bail if he was arrested over the “White Van” incident.

The third bail application is expected to be taken up before the Colombo Chief Magistrate’s Court this afternoon.

Rajitha arrives at Colombo Chief Magistrate’s court - (10:46am)

Former Health Minister Rajitha Senaratne arrived at the Colombo Chief Magistrate’s Court for the hearing of his second anticipatory bail application which he filed on Friday.

He filed an anticipatory bail application on Thursday (19) in the Colombo Chief Magistrate’s Court to prevent his arrest over white van incident.

Chief Magistrate Lanka Jayaratne fixed inquiries into the anticipatory bail application for today. Former Minister Rajitha Senaratne filed an anticipatory bail application yesterday seeking an order to release him on bail if he was arrested over white van incident.

However, Senaratne’s anticipatory bail application was rejected by the Colombo Chief Magistrate when it was taken up for consideration Thursday morning.

Senaratne filed another anticipatory bail application requesting the court to release him on anticipatory bail before the CID takes him into custody.
