Lawyer gets eight-month suspension for recording Easter Attack Commission evidence

The Supreme Court yesterday (24) ordered the suspension of the practice of a lawyer for a period of eight months after he was found guilty of recording an evidence inquiry by the Presidential Commission investigating the matters related to the attacks that took place on Easter Sunday. This order was made after examining the facts related to a complaint filed by the secretary of the relevant Commission against the said lawyer.

It is stated in the relevant decision that “Mohammed Mursia Marsha Mulla” was giving evidence on behalf of the “All Ceylon Jamiyathul Ulama” on September 9, 2020, before the Presidential Commission that investigated the facts regarding the Easter massacre. At that time, the respondent lawyer had recorded the evidence giving with his mobile phone.

The Secretary of the Commission H. M.B.P Herath had filed a complaint to the Supreme Court against the lawyer and a hearing was conducted under the violation of the Supreme Court Rules.

Pronouncing its decision, the Bench has stated that the twenty-third rule mentioned in the Supreme Court Rules is violated by the actions of the lawyer.

Therefore, as a punishment, the bench has decided to order the suspension of the lawyer’s practice for a period of eight months from the first of January 2024.
