Lanka Hospitals share issue: CA refuses Lyca, Haims petition

The Court of Appeal yesterday refused to extend the interim order issued regarding the process of distribution of government-owned shares in Lanka Hospitals Corporation PLC.

The order was delivered when the petition was taken up before Court of Appeal Justice Mohammed Laffar.

Accepting the preliminary objections raised by Additional Solicitor General Sumathi Dharmawardane appearing for the Attorney General Court refused to extend the interim order stating that there is no basis to extend the order by Court.

At a previous occasion, the Court of Appeal issued an interim order after considering the submissions made by counsels who appeared for the petitioners Lyca Leasing Holding Limited and Haims International Limited.

The order says that the petitioners failed to file an essential affidavit within the stipulated time frame and they failed to meet the requisites to accept a bid namely Legal and Financial Criteria.

The order further says that the petitioners filed the affidavit after the deadline.

Considering the facts, the Court of Appeal refused to extend the interim order further.
