Accused in fuel station robbery acquitted

Panadura Provincial High Court judge Damith Thotawatte acquitted the accused indicted by the Attorney General in the Moratuwa fuel station robbery case, on Friday.

The accused were Nallawarige Priyankara Fernando and W. Ajith Fernando of Moratuwa. They were interdicted by the Attorney General with committing a robbery of Rs. 307,000, at gunpoint, at a Moratuwa fuel station, at around 7.30 pm on July 24, 2012. The suspects had also robbed Rs. 3,600 from two employees before they fled.

Delivering his judgement, the judge said two employees of the filling station had given evidence, but the evidence could not be corroborated. The two employees had given two different versions under cross-examination. The prosecution had not proved the indictments against the accused beyond reasonable doubt. Therefore the court decided to acquit the accused.

State Counsel Priyani Abeywardena appeared for the prosecution. Attorney-at-law Samadara Kumari Jayasinghe defended the accused.
