Counsel pleads to recall notice on CEB, dismiss case

Colombo Fort Magistrate Ranga Dissanayake on Tuesday observed that the Magistrate has to decide whether notices issued on Ceylon Electricity Board should be called back or not.

This is over the case filed by the Public Utilities Commission of Sri Lanka (PUCSL) against the Ceylon Electricity Board for its failure to submit power generation reports to the PUCSL as required by law.

President's Counsel Upul Jayasuriya appearing on behalf of the Ceylon Electricity Board informed court that there is no legality to file this case against the CEB.

Jayasuriya pleaded to recall notices issued on the CEB. Jayasuriya further pleaded to dismiss the case filed against his client.Jayasuriya mentioned several legal aspects related to this case.

Jayasuriya further stated that the complainant had not mentioned his official power to file this case against the CEB. PC Jayasuriya also stated that PUCSL mentioned in their complaint that they had already sent notice to the CEB General Manager to submit relevant documents. Anyhow, they had not received such a letter.

The Magistrate observed that the complainant had not mentioned that the PUCSL has allowed him permission to file this case against the CEB. So far, the Magistrate observed that the Magistrate had to decide whether the case will be dismissed or not.

Attorney Sampath Edirisinghe appearing on behalf of the PUCSL states that the complainant is an agent from PUCSL. Counsel Edirisinghe also stated that complainant file this case following instructions given by the PUCSL.

The Magistrate ordered both counsel to submit their written submissions before the next calling date.
