Two FR petitions filed seeking quashing order

Two Fundamental Rights Petitions have been filed in the Supreme Court seeking an order quashing the arrest and detention order of Ven. Welwewa Siridhamma Thera and Hashan Gunathilake, who is at a detention centre in Tangalle.

The petitions were filed by Attorney-at-Law Manjula Balasooriya on behalf of Ven. Welwewa Siridhamma Thera and Hashan Gunathilake.

The petitions have cited Defence Secretary Retired General Kamal Gunaratne, IGP C.D. Wickramaratne, Criminal Investigations Department (CID) Director SSP Kavinda Piyasekara, Director SSP Prasanna Alwis, Peliyagoda Police OIC C.I. Kaluwitharana, Thalangama Police OIC C.I. Anil Jayantha and the Attorney General as the respondents.

The petitions states the arrest of petitioners on August 18 and thereafter their detention under a purported detention order under the Prevention of Terrorism Act (PTA) issued by President Ranil Wickremesinghe in his capacity as the Defence Minister is unlawful.

Therefore, the petitions seek orders quashing the arrest and detention orders as unlawful.

The petitions also seek an interim orders suspending the Detention Orders until the final determination on these applications.
